Affiliate Terms & Conditions
Upon approval of the submitted application, the Individual submitting the application accepts the status of Affiliate with Artworktee LLC (the “company”). All affiliates are entering a binding legal agreement on the following terms (the “agreement”). The affiliate status indicates continued acceptance of this agreement.
Eligibility
Our services are available only to, and may only be used by, individuals who can form legally binding contracts under applicable law. Our services are not available to persons under 18 years of age.
Changes
Artworktee may amend the terms of this agreement and notify affiliates via email, continued affiliate status indicates acceptance of the changes to this agreement.
Termination
The affiliate may at any time terminate this agreement (and effectively their affiliate status) by completing the appropriate section on the Affiliate form. The company may terminate this agreement at any time at the company’s discretion and will notify the affiliate via email. In the event that an affiliate becomes a partner, this agreement will be terminated in place of the provided partner agreement.
The company will automatically terminate this agreement (and effectively their affiliate status) with a particular affiliate if 3 months go by without a sale from the store of that particular affiliate.
Upon Termination, The affiliate store and all submitted items will be removed from the company website within 3 days. Any pending transactions or orders placed before termination will be fulfilled regardless of termination status.
Privacy
The company may not share any personal information provided by the affiliate through the affiliate form to any third party entity that is not involved in the company operations
Products and Artwork
It is the affiliate’s responsibility to ensure that they own all rights at all times to all artwork and designs uploaded on the affiliate form to create products, whether or not the artwork in question was created by the affiliate.
The company will use the artwork and designs uploaded by the affiliate to create products to be offered for purchase on the company websites. The company reserves the right to sell, promote, manufacture and distribute the previously specified products.
Payment
The company will pay a commission of 20% of the displayed retail price for each affiliate product sold on the website.
The company will pay commissions out to affiliates once a month between the 1st and the 5th (exceptions will receive prior notice) to the paypal email on file for the affiliate.
The affiliate will have full tax responsibility for payments issued by the company.
Miscellaneous
We accept no liability for any failure to comply with this agreement where such failure is due to circumstances beyond our reasonable control.
If we waive any rights available to us under this agreement on one occasion, this does not mean that those rights will automatically be waived on any other occasion.
If any of the terms of this agreement are held to be invalid, unenforceable or illegal for any reason, the remaining terms and conditions shall nevertheless continue in full force.
